  1. Work and Costs

Any and all descriptions, pictures, etc. that are included in any catalogues, price lists, ads, or other forms of communication with the Customer are only meant to provide the Customer a broad impression of the Works; nothing in any of them shall be deemed to be a part of the Contract.

The Customer is prohibited to contact ELECTRIC WORKS LONDON engineers directly or to conclude that verbal agreements between ELECTRIC WORKS LONDON engineers and the customer is to be considered part of the contract.

Every estimate provided by ELECTRIC WORKS LONDON is subject to cancellation by ELECTRIC WORKS LONDON at any time prior to receiving an unconditional acceptance from the Customer and is assumed withdrawn if not cancelled within 28 days of the estimate’s date.

If ELECTRIC WORKS LONDON offers the Customer an estimate, and the Customer accepts the estimate, in accordance with its terms, that estimate, until otherwise provided by ELECTRIC WORKS LONDON is a firm, fixed-price quotation.

ELECTRIC WORKS LONDON bases its estimate on the data that the customer has provided. ELECTRIC WORKS LONDON retains the right to inform the Customer and to adjust the projected price to account for the revised information if it becomes clear during the course of the Works that that information was either wrong or insufficient in any aspect that ELECTRIC WORKS LONDON regards to be material. In order to account for the updated information, ELECTRIC WORKS LONDON retains the right to inform the customer and raise the anticipated price.

If the cost of any relevant parts, materials, or other products, equipment rental, or transportation increases by more than 10% before the Works are completed, ELECTRIC WORKS LONDON reserves the right to inform the Customer and to offer a revised estimate taking that rise into account. If so, the updated estimate will take effect unless the customer terminates the Contract prior to the start of the Works or, if earlier, within 48 hours of receiving the revised estimate.

ELECTRIC WORKS LONDON shall be allowed to mark up any components, materials, and other items it provides, subject to a maximum mark-up of 65% of the actual cost paid by, ELECTRIC WORKS LONDON for the relevant item. This right will be determined by market practise. At, ELECTRIC WORKS LONDON’s sole discretion, the mark-up will represent the amount of trade or other discount that, ELECTRIC WORKS LONDON was able to secure from the pertinent supplier.

  1. Accessing our Site

Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice. We will not be liable for any disruption or non-availability of the website.

  1. Payment terms.

50% of the invoice amount should be paid right away, for all bookings. If an invoice is not paid before the engineers arrive, the engineer will be unable to provide the customer with the services booked. The business could not be held liable for the repercussions of failing to provide a certificate with an unpaid invoice. If an invoice is unpaid for more than 30 days, there will be extra costs.

  1. Appointment amendments and cancellations:

To change or cancel a scheduled appointment, the firm requires 24 hours’ notice; any changes or cancellations made by the customer within 24 hours will be subjected to a £50 charge/cost, plus any supplies purchased particularly for the work. In the case of an Electrical Condition Report issued, the customer is fully responsible for any dangerous condition stated within the report that may lead to a hazardous situation. Engineers operate on their own Electrical Registration, and are thus fully liable for any electrical work they perform, as well as any resulting liabilities. Electrics Works London shall be entitled to full reimbursement of any expenses or damages incurred by any operative/engineer/contractor whose carelessness or defective workmanship causes Electrics Works London to be held responsible for such damages or work correction.

  1. Title to any goods

The ownership of products supplied by ELECTRIC WORKS LONDON to the Customer does not pass to the Customer; rather, the ELECTRIC WORKS LONDON retains ownership of such goods until the Customer pays ELECTRIC WORKS LONDON in full for such goods. Until ownership to the products has passed to the Customer, ELECTRIC WORKS LONDON has unlimited power to repossess, sell, or otherwise deal with or dispose of all or any portion of the goods in which title remains vested in ELECTRIC WORKS LONDON. ELECTRIC WORKS LONDON or any of its agents or authorised representatives shall have the right to enter any premises in which goods or any part thereof is installed, stored, or kept, or is reasonably believed to be so, at any time and without notice for the purpose indicated in I above. ELECTRIC WORKS LONDON shall have the right to obtain a court order prohibiting the Customer from selling, transferring, or otherwise disposing of the products. Regardless of the foregoing, risk in such goods passes to the Customer upon delivery, and the Customer shall insure such goods to their replacement value until title in such goods passes to the Customer, and the Customer shall provide ELECTRIC WORKS LONDON with a certificate or other evidence of such Insurance upon request.

If there is no answer at the door, the Engineer can wait up to 15 minutes after the appointment time. The ELECTRIC WORKS LONDON shall not be liable for any delay in completing any of its duties, or for the consequences of any such delay, if the delay is caused by any cause beyond its reasonable control, and ELECTRIC WORKS LONDON shall be entitled to a reasonable extension of time to execute their responsibilities, this extension if caused by the customer or their third-party will be subject to additional charges to paid by the customer to ELECTRIC WORKS LONDON. ELECTRIC WORKS LONDON shall only be accountable for correcting works done by ELECTRIC WORKS LONDON and shall not be liable for any subsequent harm or claims stemming from this or other work neglected or requested later and not executed at the time or stated within the contract.

  1. ACCESS, LICENSES, PERMITS AND OTHER CONSENTS

Unless ELECTRIC WORKS LONDON has agreed differently in writing, it is the Customer’s obligation to secure all permits, licences, and other consents related to the Works. The Customer is responsible for ensuring that ELECTRIC WORKS LONDON has unobstructed access to carry out the Work and for making all necessary arrangements with the appropriate parties or authorities for any traffic controls and signals necessary in connection with the Work. The customer accepts all responsibilities for any delays and cancelation which is brought up due to lack of access to the site where works are meant to be carried out by the customer or third-party. 

For the purposes of carrying out the Works, the Customer shall at all times ensure a secure working environment for ELECTRIC WORKS LONDON and its employees, agents, and subcontractors. When a property is occupied but the only inhabitant is a minor, ELECTRIC WORKS LONDON will not be required to enter.

If it is necessary for the proper execution of the Works, the Customer must secure any permissions required for ELECTRIC WORKS LONDON’s to cross third-party property. The Customer must also secure any permissions required to carry out work on third-party property. Except in cases where such claim is clearly attributable to ELECTRIC WORKS LONDON’s fault, the Customer will defend ELECTRIC WORKS LONDON’s against all claims of any kind made by such third parties arising out of ELECTRIC WORKS LONDON’s presence on the Customer’s or such third parties’ property. Any loss or damage, whether direct, indirect, or consequential, incurred by ELECTRIC WORKS LONDON as a result of the Customer’s failure or delay in meeting their responsibilities under this clause will be the responsibility of the Customer to ELECTRIC WORKS LONDON.

Before the Works begin, the Customer shall, at the Customer’s expense, remove all fixtures and fittings from the working areas. Any fixtures and fittings that are not removed by the customer may be removed by ELECTRIC WORKS LONDON at their expense, but ELECTRIC WORKS LONDON will not be held liable for any damage to such fixtures or fittings, unless that damage can be proven to have been caused by ELECTRIC WORKS LONDON’s carelessness.

  1. PAYMENTS

Customers are responsible to settle payments once the Works have been completed.

If the Customer is represented by a third party (such as a managing agent, tenant or other occupier, contractor, or other representative), that party will be held liable for payment in the event that the Customer fails to make payments, unless ELECTRIC WORKS LONDON has expressly agreed in writing to the contrary.

In the case of consumer customers, ELECTRIC WORKS LONDON is entitled to daily interest on any amount not paid by the due date for payment from the due date until payment in full at 4% above the Bank of England base rate at the relevant time, in addition to any fees incurred by any collection agent hired by ELECTRIC WORKS LONDON (with a minimum charge of £40 plus VAT in the case of amounts under £1,000 and a minimum charge of £75 plus VAT in the case of amounts of £1,000 or more). The Late Payment of Commercial Debts (Interest) Act of 1998, as amended and supplemented from time to time by Government law or regulation, will be applied in the case of commercial customers, and ELECTRIC WORKS LONDON will apply all pertinent interest and fees as permitted.

  1. DATES OF THE START AND END OF THE PROJECT

The start and end dates for the Works are simply provided as approximations. ELECTRIC WORKS LONDON shall make all commercially reasonable efforts to be present on the scheduled date and time. It does not, however, accept responsibility for late or absent material delivery or for failure to show up at all. Time shall not be of the essential of the Contract.

  1. FORCE MAJEURE

ELECTRIC WORKS LONDON will make every effort to complete the Works by the specified dates, but it will not be held responsible if a strike, lockout, labour dispute, act of God, or other event or circumstance beyond its control makes it impossible or impractical to complete the Works by the specified dates or at all.
